1. Parties
- Seller: Konzila. The address, phone number, email, tax and MERSIS details are in the Contact section at the end of this page.
- Buyer: the company or person who makes the payment and whose name, address and tax details are saved in the billing details in the app.
2. Subject of the agreement
The subject of this agreement is the online provision of the Konzila subscription plan or extra credit pack chosen by the buyer on the payment screen, in return for the price shown on the payment screen. The characteristics of the service, its price and the payment method are set out in the Pre-Contract Information Form, which forms an integral part of this agreement.
3. Price and payment
- The price is the amount, including all taxes, shown on the payment screen and is paid in advance by card through the iyzico payment infrastructure.
- Prices are in US dollars (USD); cards issued in Türkiye are charged the Turkish lira equivalent at the exchange rate of the payment date.
- The subscription is monthly and renews automatically on the same day every month until the buyer cancels it. On the payment screen, the buyer agrees that each period's fee is charged automatically to the saved card. If a renewal cannot be charged, the seller may suspend the service until payment is made.
- An extra credit pack is a one-off purchase and is only sold to buyers with an active subscription.
4. Provision of the service
Immediately after the payment is confirmed, the seller activates the subscription or credits in the buyer's account. The service is provided online; there is no physical delivery. On the payment screen the buyer expressly requests that the service starts immediately.
5. Right of withdrawal
Since the service is performed instantly online and the buyer has expressly agreed that it starts immediately, the buyer has no right of withdrawal under Article 15(1)(ğ) of the Distance Contracts Regulation.
6. Cancellation, plan changes and refunds
- The buyer can cancel the subscription at any time on the Account Management screen in the app. Cancellation takes effect at the end of the paid period and no fee is charged for the next period.
- An upgrade takes effect immediately and the fee for the remaining time of the period is deducted from the price of the new plan; a downgrade takes effect at the end of the period.
- The subscription fee for a period that has started, extra credit packs and credits used are non-refundable. For erroneous or duplicate charges, and where the service could not be provided at all for a reason attributable to the seller, the amount paid is refunded to the card. 7. Obligations of the parties
Use of the service is subject to the Terms of Use, and the processing of personal data to the Privacy Policy. The buyer is responsible for the accuracy of the billing details and the security of the account.
8. Disputes
This agreement is governed by the laws of the Republic of Türkiye. A buyer acting as a consumer may apply to the consumer arbitration committee within the monetary limits set each year by the Turkish Ministry of Trade, and to the consumer courts above these limits. For disputes with merchant buyers, the courts and enforcement offices at the seller's registered seat have jurisdiction.
9. Entry into force
The agreement enters into force when the buyer confirms on the payment screen that they have read and accepted this agreement and the Pre-Contract Information Form. The date of the confirmation and the version of the accepted texts are kept with the payment record.
